The following Terms and Conditions are valid for the SOFTWARE "Aibase" from Aibase Creative Software (ACS).
Privacy Policy: ACS stores and uses customer data (gathered from purchase, support) only in conjunction with SOFTWARE licensing and support. ACS does not share the customer data with other vendors or parties.
Refund Policy: Given the nature of software licensing with license files, refunds are not possible. A license file is not returnable. Therefore, please utilize the Aibase Trial version to judge the usefulness of the program beforehand as ALL SALES ARE FINAL. The Trial version (more than Demo versions) supports the try-before-you-buy model to allow intensive evaluation.
Licensing: The SOFTWARE is protected by copyright laws and international treaty provisions. The SOFTWARE is only licensed, not sold. Through downloading, installing, copying or using the SOFTWARE "Aibase" you are expressing your consent to the EULA (End User License Agreement).
Aibase Creative Software (ACS) hereby gives you (the "Licensee") a non-exclusive license to use the software "Aibase".
The Trial Version license is granted and use-count-limited. You may freely distribute the unmodified Trial Installation Package, provided that no means to activate the Full Version are added.
For the Full Version, you have to pay the license fee according to the order page. After payment, you can activate the Full Version with your customized license file. You may install the Full Version on maximal two computers and one portable disk, but the program may be used on only one device at any one time, and only by you primarily.
You may NOT pass on the customized license file (or its content) you received after payment, and which is used for activating the Full Version. This license file may only be stored and used by you. There is no obligation for ACS to replace lost or damaged license files. You have to take all reasonable and necessary precautions to ensure the license file cannot be accessed by other persons.
You may NOT modify, translate, reverse engineer, decompile or disassemble the program. (except to the extent applicable laws specifically prohibit such restriction).
You may NOT create derivative works based on the Software.
You may NOT copy the Software, except the unmodified Trial Installation Package.
You may NOT rent, lease, transfer or otherwise transfer rights to the Software.
You may NOT remove any proprietary notices or labels on the Software.
Licensees not fulfilling these obligations, are liable for all damages that occur as a direct or indirect consequence to ACS.
Termination: The license will terminate automatically if you fail to comply with the limitations described above. On termination, you must destroy all copies of the Software (incl. license file) and Documentation.
Disclaimer Of Warranty: The Software is provided on an AS IS basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk as to the quality and performance of the Software is borne by you. Should the Software prove defective, you and not ACS assume the entire cost of any service and repair. ACS IS NOT RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.
Title, ownership rights and intellectual property rights in and to the Software shall remain in ACS. The Software is protected by international copyright treaties.
